First. -ORGANIZING COMPANIES, PURPOSE, DURATION, AND SCOPE

The promotional draw is organized by the following parties:

1. The company Karibu Experience S.L. (hereinafter, "Karibu Experience") with registered address at Calle José Abascal 31, 28003, Madrid and Tax ID Number B-16944282.

2. The company Kuoom Group Limited with address VMGX+746, Robanda, 31623, United Republic of Tanzania and TIN 162-809-784.

3. The individual Ángel Gómez Merino, residing at Prado del Rey 59 3B, 28223, Madrid, with ID number 53940539L.

The "Win a safari for two" prize draw (hereinafter, the "Promotion") is being organized for promotional purposes on an international scale, to be carried out via the Internet, with participation open to participants of legal age.

The Promotion will begin on August 18, 2024, at 6:00 p.m. (Spanish peninsular time) and end on September 8, 2024, at 10:00 p.m. (Spanish peninsular time).

Notwithstanding the foregoing, the three organizers reserve the right to modify the dates of the Promotion at their convenience.

Second. – PARTICIPATION REQUIREMENTS

All persons (hereinafter, the "Participants") who accept these Legal Terms and Conditions and comply with the following rules of participation may participate in the promotion:

● Be over 18 years of age and have a valid Instagram profile.

● Follow the Karibu Experience profile (@karibuexperience).

● Follow Ángel Gómez Merino's profile (@listbyangel_).

● Follow Kuoom Serengeti (@kuoomserengeti). ● Comment on the promotional reel shared between the three profiles above and mention one (1) friend, family member, or acquaintance who has a valid Instagram profile in the comments of the promotional reel for the giveaway.

● Post the promotional reel as a "Story" on your Instagram profile.

Participation in this contest, as well as the publication of comments made by Participants, may not under any circumstances violate Instagram's Community Guidelines or Terms of Use.

Third. – PRIZES, PROMOTION TERMS AND CONDITIONS, AND HOW TO REDEEM

Specifically, the winner will be selected by means of a draw using the EasyPromos application or similar among users who have met the participation requirements. Participants who have not followed all the steps of the promotion will be automatically eliminated from the draw. Any profile that is detected as fake or that commits fraudulent acts will also be eliminated from the draw.

Once @listbyangel_ knows who the winner is, they will announce it on September 10, 2024, via their Instagram profile (@listbyangel_).

The prize for this Promotion specifically includes:

● 5 days of full-board safari* in the Serengeti (4 nights at Kuoom Serengeti) and Ngorongoro parks.

● 1 night full board* in Arusha (Olerai Lodge or similar).

Regarding the terms and conditions of the prize: (i) the dates are at the request of the winner and subject to the availability of the activities mentioned above, (ii) once the winner confirms the dates on which they wish to enjoy the prize, no changes can be made, (iii) the prize will be valid for travel between xxx and xxx and April 1, 2021, (iv) flight costs, transportation, meals, tips, excursions, travel insurance, or extra expenses not described are not included, and (v) prizes are non-transferable and cannot be exchanged for cash or other products. (vi) Half board covers breakfast and dinner without alcoholic beverages, and full board covers breakfast, lunch, and dinner without alcoholic beverages.

If the winner cannot be located or contacted within seven (7) calendar days of the date of notification by @listbyangel_, the prize will be awarded to the next person in line who meets the entry requirements, chosen at random, and it will be understood that the first winner irrevocably waives the prize awarded. If the alternate Participant cannot be located within a further period of seven (7) calendar days from the notification sent by @listbyangel_, the prize will be declared void.

The winner shall be responsible for any tax charges that may arise from accepting the prize, as well as any other expenses arising from the Promotion that are not expressly assumed by any of the parties in these Legal Terms and Conditions.

Fourth. – LIMITATIONS

The following persons, or their spouses, ascendants, or descendants up to the second degree (inclusive), may not participate in the Promotion: (i) Employees of any of the companies and other legal entities linked to any of the parties, (ii) Individuals who participate directly or indirectly in the capital of any of the parties, (iii) the Notary appointed to record these rules, or any of the employees of said Notary's office, and (iv) any other individual who has participated directly or indirectly in this Promotion or has been involved directly or indirectly in its preparation or development (agency, suppliers, etc.).

By accepting these Legal Terms and Conditions, Participants consent to either party excluding or disqualifying these entries from the Promotion.

Entries made after the end date of the Promotion, as well as those that do not meet the requirements set out in section two of these Legal Terms and Conditions, will be considered null and void. The three parties involved reserve the right to exclude from the Promotion any Participants who are suspected or found to have participated in any fraudulent manner.

If it becomes evident that the winners or alternates do not meet the requirements set forth in the Terms and Conditions, or fail to provide the requested documentation, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prize awarded under this Promotion.

The prize awarded shall not be subject to changes, alterations, or compensation at the request of the winners, and cannot be exchanged for any other product or for cash. The three parties involved reserve the right, if there is just cause and prior notification in legal form, to make any changes, suspend, or extend this Promotion.

A period of fifteen (15) calendar days from the date of the award of the prize is established for making any claim related to this Promotion. Once fifteen (15) calendar days have elapsed from the date of the award of the prize, the trip will be formalized and/or managed.

This document hereby certifies that the Participants are not required to pay any additional amount to KARIBU EXPERIENCE as a result of the proposed draw.

The three parties involved reserve the right, in case of necessity, to substitute the prizes for others of similar characteristics.

Fifth. – DISCLAIMER OF LIABILITY.

By way of example and without limitation, the three parties involved shall not be liable for the following circumstances:

● The winner's use of the prize that is the subject of this Promotion.

● Any damages of any kind that may be due to the temporary lack of availability or continuity of the operation of telecommunications networks.

● Services provided by any other entity with which the three parties involved collaborate in providing services to the winner as a result of the prizes awarded, as well as those arising from negligent conduct in the enjoyment of said services.

● Cases of force majeure or unforeseeable circumstances that could prevent the Promotion from taking place or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the Promotion, technical errors, or any other reason beyond the control of KARIBU EXPERIENCE that affects the normal running of the Promotion, KARIBU EXPERIENCE reserves the right to cancel, modify, or suspend the Promotion.

Sixth. – LIMITATIONS ON THE CONTENT OF PHOTOS AND COMMENTS.

● Discrimination: Under no circumstances may content be created with the intention of discriminating against third parties or violating the principles of the right to honor, personal and family privacy, personal image, and human dignity. Any type of discriminatory content is prohibited, whether based on race, sex, religion, opinion, nationality, disability, or any other personal or social circumstance.

● Illegal activities: Content may not promote illegal activities or include obscene or defamatory material.

● Self-destructive content: Content that promotes the use of narcotic substances or that could incite eating disorders and self-harm is prohibited.

● Violence: It is expressly prohibited to participate with photos and comments that promote violence and/or that include, without limitation, sexual violence or violence against animals and people. ● Degrading content: Photos and comments that are intimidating, threatening, degrading, or in any way promote violence against a specific person or group are not permitted.

● Sexual content: It is expressly prohibited to include any type of sexual content.

If it is proven that any of the Promotion Participants has incurred any of the limitations established in this section, the three parties involved reserve the right to exclude said Participant from this Promotion.

The three parties involved are not responsible for any damage caused by the content included in the photographs published by the Participants in the Promotion, which at any given time may offend the sensibilities of other Participants. Therefore, the three parties involved decline all legal and judicial responsibility for all photographs and descriptions.

Seventh. – PROTECTION OF PERSONAL DATA

The three parties involved take the protection of your privacy and personal data very seriously. Therefore, your personal information is stored securely and treated with the utmost care.

In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter, "GDPR") and Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, "LOPDGDD"), each Participant, by accepting these Legal Terms and Conditions, consents to the personal data provided for participation in this Promotion being incorporated into a database owned by the three parties involved in order to process the Participant's participation and to notify them of the prize in the event that they are a winner.

The three parties involved maintain adequate security in accordance with the GDPR and the LOPDGDD, and have established all technical means at their disposal to prevent the loss, misuse, alteration, unauthorized access, and theft of the data provided by Participants through the Promotion, without prejudice to informing them that security measures on the Internet are not impregnable.

The three parties involved undertake to comply with the duty of secrecy and confidentiality with regard to the personal data contained in the automated file in accordance with applicable legislation, as well as to process them securely in any transfers that may occur. The Participant guarantees that the personal data provided is accurate and is responsible for notifying KARIBU EXPERIENCE of any changes thereto.

The Participant shall be responsible, in any case, for the accuracy of the information provided, and KARIBU EXPERIENCE reserves the right to exclude from the Promotion any Participant who has provided false information, without prejudice to exercising any other legal actions that may be applicable. It is recommended that the utmost diligence be exercised in matters of Data Protection through the use of security tools, and KARIBU EXPERIENCE cannot be held responsible for any unlawful theft, modification, or loss of data.

We inform you that you can exercise your rights of access, rectification, deletion, opposition, limitation, portability, erasure, and not to be subject to automated individual decisions by sending an email to info@karibuexperience.com, or by letter addressed to Calle José Abascal 31, 28003, Madrid, attaching a copy of your ID card.

Eighth. – CHANGES AND ACCEPTANCE

The three parties involved reserve the right to modify or extend these promotional terms and conditions, provided that this does not harm or undermine the rights of the Participants in the Promotion.

Participation in the Promotion implies full acceptance of these Legal Terms and Conditions by Participants who register for this Promotion, which may be recorded in a document certified by a Notary Public and will be available to anyone who wishes to consult them.

Ninth. – APPLICABLE LAW AND JURISDICTION

These Legal Terms and Conditions shall be interpreted and governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participants shall be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation, or compliance with these terms and conditions.
